Refunds
- Any check sent to a customer or credit card refund will
incur in a 15% administration fee or a $3.00 fee, whichever is higher, which
will be subtracted from the total amount of the refund.
- Any check sent to a customer outside the United States
will incur in a delivery fee which will be subtracted from the total amount
of the check.
Downgrades
If a downgrade to an account is requested, the current 3
months of service will not get part of it refunded/adjusted.
99.95% Uptime Guarantee
We guarantee that 99.95% of the time your web site will be
accessible via IP address to the world. The IP address is the numerical
value equivalent to www.yourdomain.com. If your web site is not online
99.95% of the time we will refund the percentage of your monthly hosting
fees equal to the downtime.
For purposes of this guarantee, Service Outages shall be defined as 20
consecutive minutes of web site (HTTP) inaccessibility. This means 20
continuous minutes, an unbroken sequence of 20 minutes of network outage.
But, this guarantee does NOT include:
- planned outages
- partial outages of less than 30 contiguous minutes
- degradation of service due to high packet loss
- any conditions which may be indicative of the
Internet as a whole
- specific customer's network/personal computer
hardware failure
We will not be held responsible for Service Outages
resulting from non-Jhanna operated equipment including, but not limited to,
Internet NAP failures or congestion (MAE East, MAE West, etc.) and non-Jhanna
backbone failures, telephone circuits between a POP and the customer
location any networks or network equipment not owned or controlled by us.
Additionally, Service Outages will not include downtime due to Acts of God,
nor for outside security breaches, acts of any governmental body, war,
insurrection, sabotage, embargo, fire, flood, strike or other labor
disturbance, interruption of or delay in transportation, unavailability of
interruption or delay in telecommunications or third party services,
including DNS propagation, domain name registration/transfer/expiration,
failure of third party software or hardware or inability to obtain raw
materials, supplies, or power used in or equipment needed for provision of
your web site. In addition, a client breaking any or terms and conditions in
our "policies" causing a machine to fail as a result.
Furthermore, we will not be held responsible for delays in the registration
or transfer of a domain due to InterNIC related issues, including DNS
propagation, for outages resulting from malfunctioning customer scripts or
applications that are installed by the customer, nor for unusual traffic
spikes or DOS (denial of service) attacks on customer web sites.
Finally, we will not be held liable for Service Outage damages resulting in
the loss of prospective profits or anticipated sales or as a result of
expenditures, investments, or commitments in connection with the business.
Search Engine Submission
Submission credits are not refundable and not transferable.
IP addresses
We are not responsible for disruption of service caused by
changes in IP addresses. Although we will do everything possible to maintain
uptime in such event, customers handling DNS externally might experience
downtime if they don't update their DNS servers correctly.
We reserve the right to modify these policies, procedures, services and prices
at any time with no previous warning. We are not responsible for typographical
or translation errors. We are not responsible for loses that may occur from
using our service. Even though we try to send emails regarding policy changes,
procedures, services and prices, we are not responsible for the non-arrival of
such emails, due to, but not limited to, anti-virus and anti-spam filters,
problems on your ISP's email servers, etc.
